1. Covered Entities

This Privacy Policy describes how Mogul Flagship Inc., operating under the Mogul Clubs, Mogul Clubs Oshawa, Frontcourt.ai, and Mogul Sports Network brands (collectively, "we", "us", or "our"), collects, uses, discloses, and protects personal information. We are accountable for personal information under our control.

2. Information We Collect

We collect personal information necessary to provide our services, including:

  • Account and identity information: name, date of birth (for age verification and minor classification), email address, phone number, photograph for facility verification;
  • Booking and gameplay data: court bookings, check-ins via QR scan, session participation, ranking and DUPR data, match results;
  • Payment information: payment method tokens and billing records (full card numbers are handled by our payment processor, Stripe, and not stored on our systems);
  • Communications: support requests, feedback, and message history;
  • Technical information: device, browser, IP address, log data; and
  • Sensitive information where applicable: emergency contacts, accessibility notes, and incident-report content.

3. How We Use Information

We use personal information to:

  • deliver and operate our services, including booking, check-in, league play, training, and events;
  • process payments, manage memberships, and issue receipts;
  • communicate operationally (booking confirmations, schedule changes, incident notifications, safety notices);
  • communicate optionally (marketing emails, events, promotions) subject to CASL-compliant consent and an unsubscribe option in every commercial message;
  • improve our services, including analytics on facility utilization and platform performance;
  • comply with legal, regulatory, insurance, and safety obligations.

4. Sharing with Third Parties

We share personal information only as necessary:

  • Service providers acting on our behalf (e.g., hosting, payment processing, email delivery, analytics) under contractual obligations of confidentiality and use limitation;
  • Insurance carriers and legal advisors where reasonably necessary in connection with an incident, claim, or dispute;
  • Public authorities where required by law, court order, or to protect the safety of any person; and
  • Successors in the event of a corporate transaction, subject to the same protections set out in this Policy.

We do not sell personal information.

5. Retention

We retain personal information only as long as necessary for the purposes for which it was collected, to comply with legal obligations, and to support legitimate business interests. Examples: signed legal acceptances are retained for the limitation period applicable to the underlying agreement; financial records are retained per Canada Revenue Agency requirements; security-relevant access logs are retained per insurance-carrier expectations. Inactive accounts are subject to deletion or anonymization after a defined retention window.

6. Your Rights

Subject to applicable law, you have the right to:

  • access the personal information we hold about you;
  • correct inaccurate or incomplete information;
  • withdraw consent for non-essential uses (e.g., marketing) at any time;
  • request deletion or anonymization where permitted by law; and
  • complain to the Office of the Privacy Commissioner of Canada.

Requests may be sent to privacy@mogulclubs.com. We may require reasonable identity verification before responding.

7. Security

We use administrative, technical, and physical safeguards to protect personal information, including access controls, encryption in transit and at rest where applicable, RLS-protected database access, and audit logging on sensitive operations. No system is perfectly secure; we will notify affected individuals in accordance with applicable law if a breach materially affects them.

8. International Transfers

Some service providers process personal information outside of Canada. By using our services, you acknowledge that personal information may be subject to the laws of jurisdictions other than your own.

9. Children

We collect minimal personal information about minors and only with parent/guardian consent through the Parent/Guardian Consent and Minor Participant Waiver. Marketing communications are not directed at minors.

10. Changes to This Policy

We may update this Policy on prospective notice. Material changes will be communicated at least thirty (30) days in advance where practicable.
