Electronic Signature and Records Consent

1. Purpose

This Consent records your agreement to receive disclosures, agreements, and notices electronically, and to sign documents using electronic signature methods, when interacting with Mogul Flagship Inc. and its affiliated brands.

2. Covered Entities

This Consent applies to electronic records and signatures exchanged with Mogul Flagship Inc., Mogul Clubs, Mogul Clubs Oshawa, Frontcourt.ai, and Mogul Sports Network.

3. Legal Basis

This Consent is given pursuant to the Electronic Commerce Act, 2000 (Ontario) and analogous federal and provincial legislation. You agree that an electronic signature, click-acceptance, or typed-name signature submitted through Frontcourt.ai or another Mogul Clubs platform has the same legal effect as a hand-written signature.

4. Scope

This Consent covers documents in our legal document library, including without limitation the Master Annual Participant Waiver, Membership Terms and Conditions, Corporate Event Participant Waiver, Corporate Event Organizer Agreement, Parent/Guardian Consent and Minor Participant Waiver, Independent Contractor / Coach / Trainer Agreement, Facility Code of Conduct, Privacy Policy, and operational notices.

5. Hardware and Software Requirements

To receive and review electronic records you require: (a) a modern web browser; (b) reliable internet access; (c) the ability to receive email at the address on file; (d) the ability to view PDF documents; and (e) sufficient storage to download copies of records if desired.

6. Right to Receive Paper Records

On written request to hello@mogulclubs.com you may receive a paper copy of any electronic record. A reasonable fee may apply for paper copies.

7. Withdrawal of Consent

You may withdraw this Consent at any time by notifying hello@mogulclubs.com in writing. Withdrawal applies prospectively only and does not affect the legal effect of records exchanged or signed prior to withdrawal. Withdrawal may make it impractical for us to continue providing certain services that depend on electronic delivery, and may result in suspension or termination of membership or contractor status.

8. Updates to Contact Information

You agree to keep your email and other contact information current so electronic records can be delivered. We are not responsible for non-receipt where the failure is due to outdated or incorrect contact information you have provided.

9. Governing Law

This Consent is governed by the laws of the Province of Ontario.

Acknowledgement and Acceptance

By indicating consent below, you confirm that you have read and understood this Consent and that you agree to receive and execute documents electronically as described.
